Terms of Service

Welcome to OrbitingFox. These Terms of Service ("Terms") are the agreement between you and OrbitingFox ("we", "us") that applies whenever you use orbitingfox.com and its related services (the "Service"). We've written them in plain language on purpose — please actually read them; they matter.

The short version

  • Your content stays yours; you give us only the permission needed to store and process it so the Service works for you.
  • Use the Service legally and respectfully; don't attack it or other users.
  • AI features are helpful assistants, not professional advisors — you stay responsible for decisions you make.
  • The Service is provided as-is; our liability is limited as described below.
  • You can leave anytime; we can suspend accounts that break these rules.

1. Accepting these Terms

By creating an account or using the Service, you confirm that you have read and agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

2. The Service

OrbitingFox helps you capture notes and tasks ("Winks"), organize goals and projects, and use AI features grounded in your own content. We are always improving the platform, which means features may be added, changed, or retired over time. For significant removals of functionality you rely on, we will make reasonable efforts to give advance notice.

3. Who may use OrbitingFox

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) and able to form a binding agreement. You may not use the Service if you have previously been banned from it.

4. Your account

  • Provide accurate information, including a working email address you control.
  • Keep your password confidential — you are responsible for activity that happens under your account.
  • Tell us promptly via the contact page if you suspect unauthorized access.

5. Your content

Everything you create or upload — notes, tasks, goals, files, recordings — remains your content. You grant us a limited, non-exclusive license to host, store, back up, process, and display that content solely to operate and improve the Service for you. This license ends when your content is deleted from our systems. You are responsible for having the rights to the content you upload and for ensuring it is lawful.

6. AI features

Some features generate text, summaries, transcriptions, or suggestions using artificial intelligence. AI output can be incomplete, outdated, or simply wrong. It is provided for convenience and inspiration — it is not legal, medical, financial, tax, or other professional advice, and you should verify anything important before acting on it. You are responsible for how you use AI output.

7. Acceptable use

When using the Service, you agree not to:

  • break any applicable law, or upload content that is illegal, infringing, or harmful to others;
  • attempt to breach, probe, overload, or disrupt the Service or its security measures, or access another user's data;
  • use automated tools to scrape the Service or send spam through it;
  • resell, sublicense, or misrepresent the Service as your own;
  • reverse-engineer the Service except where the law expressly permits it.

8. Plans, payments, and changes

OrbitingFox offers a free plan and may offer paid plans with additional capacity or features. Prices and plan contents are shown on the plans page and may change; changes to a paid plan you are on will apply from your next billing period, with notice. Where required by law, refunds are handled accordingly; otherwise payments are non-refundable.

9. Ending the relationship

You may stop using the Service and request account deletion at any time. We may suspend or terminate accounts that violate these Terms, create risk or legal exposure for us or other users, or remain inactive for an extended period (with notice where practical). Upon termination, your license to use the Service ends; sections of these Terms that by their nature should survive (such as limitations of liability) survive.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied — including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will never be lost; keep your own copies of anything critical.

11. Limitation of liability

To the maximum extent permitted by law, OrbitingFox and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) fifty US dollars (USD $50). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Your responsibility to us

If your violation of these Terms, your content, or your misuse of the Service causes a third-party claim against us, you agree to cover the reasonable costs and damages arising from that claim.

13. Changes to these Terms

We may update these Terms as the Service evolves. For significant changes we will give notice (by email or an in-app notice) before they take effect. Continuing to use the Service after the effective date means you accept the updated Terms; if you do not, stop using the Service and contact us to close your account.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which OrbitingFox's operator is established, without regard to conflict-of-law rules, and disputes will be resolved in the courts of that jurisdiction unless applicable law gives you the right to another venue.
